  • BUSINESS INTERRUPTION

EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PGP CONSTRUCTION’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID, IF ANY, TO ACCESS THE SITE OR USE THE SERVICES.

9. Indemnification

You agree to indemnify, defend, and hold harmless PGP Construction, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of:

  1. Your use of the Site;
  2. Your violation of these Terms;
  3. Your User Content; or
  4. Your violation of any law or third-party rights.

10. Account Termination

We may, in our sole discretion, suspend or terminate your access to the Site or any portion thereof at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Sections that by their nature survive termination (such as intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) shall remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

12. Dispute Resolution

  1. Informal Resolution: Before pursuing any formal dispute resolution, you and PGP Construction agree to attempt to resolve disputes informally by sending a written notice to the other party’s contact information below.
  2. Arbitration: Any dispute arising from or relating to these Terms shall be resolved by binding arbitration in Tarrant County, Texas, under the rules of the American Arbitration Association (AAA). Judgment on the award may be entered in any court having jurisdiction.

YOU AND PGP CONSTRUCTION EACH WAIVE THE RIGHT TO A TRIAL BY JURY.

13. Modification of Terms

PGP Construction may modify these Terms at any time in our discretion. We will post the revised Terms on the Site with the updated Effective Date. Your continued use of the Site after such changes means you accept the new Terms.

14. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.
